In these Terms, “Kingsley Beaumont”, “we”, “us” and “our” refer to HNU ECOM DEVELOPMENT LLC. “You” and “your” refer to the customer.

2. Scope of These Terms

These Terms govern the sale of products through our online store. By submitting an order, you agree to these Terms and the policies referenced within them.

Nothing in these Terms excludes or limits any mandatory consumer rights available under applicable law.

3. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications and prices are accurate.

Product colours and finishes may appear slightly different depending on screen settings, lighting conditions and the natural characteristics of materials.

Natural stone, wood, glass and metal products may contain variations in colour, pattern, texture or surface appearance. These natural variations are not necessarily defects.

Measurements are approximate unless expressly stated otherwise. You should review the dimensions, electrical specifications and installation requirements before placing an order.

4. Prices

Prices are displayed in the currency shown on the website at the time the order is placed.

The total amount payable, including applicable taxes and any delivery charges, will be displayed before you confirm payment.

Prices and promotions may change before an order is placed. Changes will not affect an order that has already been accepted, except where an obvious pricing error has occurred.

5. Payment

Payment must be made using one of the payment methods available at checkout.

Payments are processed by third-party payment providers. We do not normally receive or store complete payment card details.

Your order may be delayed or declined if payment cannot be authorised or if additional verification is reasonably required.

6. Placing an Order

Before submitting an order, you are responsible for checking:

  • The product and selected variant;
  • The quantity ordered;
  • The billing and delivery addresses;
  • Your email address and telephone number;
  • The total amount payable.

After placing an order, you will receive an automated confirmation email. This confirms that we have received the order but does not necessarily mean that it has been accepted.

The sales contract is formed when we confirm dispatch or otherwise expressly confirm that the order has been accepted.

7. Order Acceptance and Cancellation

We may decline or cancel an order for a legitimate reason, including:

  • The product is unavailable;
  • Payment cannot be authorised;
  • The delivery address is invalid or incomplete;
  • An obvious pricing or product-information error has occurred;
  • The order appears fraudulent or unauthorised;
  • The order breaches an applicable legal or delivery restriction;
  • The quantity ordered is not reasonably available for retail sale.

If payment has already been taken for an order we cannot accept, the relevant amount will be refunded to the original payment method.

If you wish to change or cancel an order, contact us as soon as possible. We will try to assist, but changes cannot be guaranteed once preparation or dispatch has started.

8. Product Availability

All orders are subject to product availability. Adding a product to the shopping cart does not reserve it.

If a product becomes unavailable after an order has been submitted, we will contact you and offer an appropriate option, such as:

  • Waiting for the product to become available;
  • Selecting an alternative product;
  • Cancelling the unavailable product for a refund.

9. Delivery

Order processing, delivery estimates, shipping charges and tracking procedures are described in our Shipping Policy.

Estimated delivery times are not guaranteed unless a guaranteed date has been expressly agreed.

You are responsible for providing an accurate and complete delivery address. Contact us immediately if you identify an error.

This does not affect your rights where a delivery problem was caused by us or by a delivery provider acting on our behalf.

10. Risk and Ownership

Responsibility for the product passes to you when it is delivered to you or to a person identified by you to receive it.

Ownership passes to you after we have received payment in full and the product has been delivered.

11. Cancellation Rights

Customers in the United Kingdom generally have 14 calendar days after receiving an order to notify us that they wish to cancel it, subject to applicable exceptions.

After notifying us, the product must be sent back within the following 14 calendar days.

12. Return Shipping Costs

Eligible returns from the United Kingdom, including change-of-mind returns accepted under our Return Policy, are free when you follow our return procedure and use the prepaid return label we provide.

If the product is damaged, defective, materially different from its description or not the product ordered, Kingsley Beaumont will also cover the return shipping costs.

We provide the prepaid return label and authorised return instructions after approving the request. Contact us before arranging or sending the return.

We do not charge a restocking fee for returns accepted under our policy.

13. Refunds

Refund eligibility, processing and original delivery charges are explained in our Refund Policy.

Approved refunds are issued to the original payment method. Your bank or payment provider may require additional time before the refund appears in your account.

14. Faulty, Damaged or Incorrect Products

Please inspect your order after delivery and contact us promptly if a product is damaged, defective or incorrect.

We may request photographs or a short video showing the product, packaging and shipping label to help us assess the issue.

Depending on the circumstances and your applicable rights, we may offer a repair, replacement, refund or another appropriate solution.

Nothing in these Terms limits mandatory rights relating to faulty, non-conforming or incorrectly described products.

15. Electrical Products and Installation

Lighting and electrical products must be installed and used in accordance with their instructions, specifications and applicable electrical requirements.

Where appropriate, installation should be performed by a suitably qualified electrician or installer.

We are not responsible for damage caused by misuse, incorrect installation, unauthorised modification or use contrary to the supplied instructions. This does not exclude responsibility that cannot lawfully be excluded.

16. Promotions

Promotions and discount codes may be subject to additional conditions, dates and exclusions displayed with the relevant offer.

Unless otherwise stated, discount codes cannot be combined, exchanged for cash or applied retrospectively to an order that has already been completed.

17. Our Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.

Nothing in these Terms excludes or limits mandatory consumer rights.

To the maximum extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the sales contract was formed or for business losses arising from a purchase made primarily for personal use.

18. Events Outside Our Control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including severe weather, carrier disruption, customs delays, natural disasters, labour disputes, government action or major technical failures.

Where an order is affected, we will take reasonable steps to minimise the impact and keep you informed.

20. Complaints

If you have a concern about a product or order, contact us using the details below. Please include your order number and a clear description of the issue.

We will review the complaint and respond within a reasonable period.

21. Governing Law

Except where mandatory consumer law provides otherwise, these Terms of Sale are governed by the laws of the State of New Mexico and applicable federal laws of the United States.

Customers in the United Kingdom and other countries retain any mandatory protections provided by the laws of their country of residence. Nothing in these Terms prevents a customer from bringing a claim before a court or dispute-resolution body where applicable law provides that right.

22. Changes to These Terms

We may update these Terms to reflect changes to our business, website, policies or legal obligations.

The version applying to an order is the version published when that order was submitted, unless a change is required by law or expressly agreed with you.
